Florida Seller of Travel Bond

Overview

Florida's seller of travel security is tiered, and the tiers are written into section 559.929 of the Florida Statutes. A registered seller of travel posts a performance bond (or other approved security) in an amount set by the Department of Agriculture and Consumer Services: up to $25,000 as the standard ceiling, or up to $50,000 if the seller offers vacation certificates. Independent statutory tiers of $100,000 and $150,000 apply in the circumstances the section describes for certain vacation certificate operations. The bond runs in favor of the department for the use and benefit of consumers injured by the seller's violations of the travel law.

Sellers of travel registering annually with the Florida Department of Agriculture and Consumer Services — travel agencies, tour operators, vacation package promoters, and businesses offering prepaid travel or tourist-related services to Florida consumers. Sellers offering vacation certificates sit in higher security tiers, and out-of-state companies selling into Florida register and post security on the same terms as in-state firms.

What is this Bond For?

Section 559.929 makes the purpose explicit: the security is for the use and benefit of any consumer injured by the seller of travel's fraud, misrepresentation, breach of contract, financial failure, or any violation of Florida's seller of travel law. If prepaid travel never materializes — a cancelled tour, an insolvent operator, an undelivered vacation certificate — the posted bond is the fund from which injured consumers can seek recovery through the department's process.

When is it Required?

With registration, and continuously while registered. Seller of travel registration in Florida renews annually, and the security must remain in force at the amount the department requires for the seller's activities. A seller that begins offering vacation certificates mid-stream moves into the higher security tiers and should adjust coverage before selling the new product.
